THE RESPONSIBILITY OF THE JUDGE WHO RELEASED THE KILLER OF LITTLE STEFAN IS BEING INVESTIGATED The Minister submitted a request, here are the possible sanctions!

On July 26, 2021, the Minister of Justice, Maja Popović, submitted a request to the High Judicial Council to review the existence of disciplinary responsibility of Radmila Đerić, the judge for the previous procedure of the First Basic Court in Belgrade, in accordance with her competencies.

The disciplinary bodies of the High Judicial Council (Disciplinary Prosecutor and Disciplinary Commission) are responsible for conducting this procedure, which should act urgently on the basis of the law so that the disciplinary procedure would not become obsolete within two years from the day the disciplinary violation was committed.

If it is determined that there is a judge’s responsibility for the committed disciplinary violation, a public reprimand can be issued, a salary reduction of up to 50 percent for a maximum of one year, as well as a ban on promotion for up to three years.

However, in addition to these sanctions, if it is determined that a judge is liable for a serious disciplinary offense, a procedure for dismissal of a judge may be initiated.

In addition, we emphasize that a judge cannot be held criminally responsible for the opinion he has expressed in the performance of his judicial function.
