The Central Election Commission (CEC) in the next meeting has discussed a request of member Arianit Elashani, reports Ekonomia Online.

He requested that all candidates who have not been certified have the opportunity to appeal to the responsible bodies up to the Constitutional Court if necessary.

He further stressed that some political entities have already exhausted the right to replace candidates, but that they have been denied the right by the ECAP to complain.

“We know that some political entities have exhausted their right regarding the replacement of candidates to have a full composition, but from this right by the ECAP they have been denied the other right that for replacement.”

“Therefore, I think that it should be reviewed with a legal basis and a decision should be made on the rejection of candidates and the request for replacement,” said Elshani.

On the other hand, Sami Kurteshi from VV said that the ECAP did not act fairly regarding the review and handling of complaints.

The same was thought by some of the other CEC members such as Alim Rama and Florian Dushi. Chairman Kreshnik Radoniqi during this discussion said that there is no reason for those candidates to ask the CEC to allow them to appeal.

“On 05.02.2021, he was tried for the criminal offense of light bodily injury under Article 185 paragraph 2 in conjunction with paragraph 1, under paragraph 1.4 of the CCRK for which he was sentenced to imprisonment for a period of one hundred and eighty (180) days, i which decision became final on 24.03.2021.

On 03.11.2020 for the criminal offense committed in co-perpetration aggravated theft from Article 253 paragraph 1 under paragraph 1 in conjunction with Article 23 of the CCK, for which a sentence of imprisonment of two (2) years was imposed, which sentence shall not be executed for a period of two (2) years if the defendant does not commit another criminal offense, which decision became final on 15.01.2021.

On 04.08.2020 for the criminal offense committed in co-perpetration aggravated theft under Article 253 paragraph 1 under paragraph 1 in conjunction with Articles 23 and 71 of the CCK, for which he was sentenced to imprisonment for a term of eight (8) month, which decision has become final 18.05.2021.

While completed cases against the defendant DK, as a juvenile, are completed by the court as follows:

On 08.10.2014, due to the criminal offense committed in co-perpetration of aggravated theft under Article 253 paragraph 1 under paragraph 1 in conjunction with Article 23 of the CCK according to the proposal for imposing an educational measure, criminal proceedings were terminated against him due to that the juvenile DK (now an adult) was sentenced to imprisonment as an adult by the Basic Court in Gjilan.

Ratko Mladic, the former Bosnian Serb general arrested on suspected war crimes, appeared in a closed hearing in a Belgrade court.

Wanted for his alleged role in the atrocities of the Bosnian conflict from 1992 to 1995, the former general looked frail and very slow as he was escorted by four guards on Thursday in the first step of the extradition process.

Tadic said the 69-year-old would be extradited to The Hague but didn’t give a timeframe.

However, European foreign policy chief Catherine Ashton said Mladic is expected to be extradited in nine or ten days.

Local media had initially reported that a man had been arrested who posed as Milorad Komadic and was believed to be Mladic.

According to Al Jazeera’s Aljosa Milenkovic, Mladic was arrested at 5:30 a.m. (3:30 a.m. GMT) on Thursday. He was clean-shaven, looked a lot to himself, but much older. His right arm was apparently paralyzed and he did not resist arrest.

Rasim Ljajic, the minister responsible for searching for fugitive war criminals, said Mladic “looked pale, as if he had been inside for a long time”.

Mladic was charged in 1995 with the Srebrenica massacre of 8,000 Muslim men and boys and the 43-month siege of the Bosnian capital, Sarajevo, in which around 10,000 people died.

The Supreme Court confirms the sentence of life imprisonment for the former police officer who killed a person in a casino in Suhareka

The Supreme Court today confirmed the sentence of life imprisonment for the former police officer, Shefki Spahiu, who last year was sentenced to life imprisonment for the murder of Jetmir Aliaj in a casino in Suhareka.

The College of the Supreme Court, in the criminal case of the accused Sh.S. from Suharek for the criminal offense of “aggravated murder” and the criminal offense of “manipulation of evidence”, deciding on the appeal of the defense counsel of the accused filed against the judgment of the Basic Court in Prizren, and the judgment of the Court of Appeals of Kosovo, at the session of the panel held on 20 May 2021, by a majority of votes, partially approved the appeal of the defense counsel of the accused Sh.S., only as regards the legal qualification of the criminal offense of “aggravated murder”, for which the accused has been found guilty, so that in the actions of the accused this court finds that the elements of the criminal offense of aggravated murder are met

Defendant Sh.S., his defense counsel, lawyer EK, representative of the injured party lawyer AR, injured party HA, and AA State Prosecutor did not participate in the public session of the panel, held on May 20. at this hearing, but with a submission, proposed that the appeal of the defense counsel of the accused be rejected as unfounded, while the judgments be upheld.

The Panel of the Supreme Court, through Judgment PA.II.nr.3 / 2021, assessed the aggravating circumstances, which have taken into account the lower courts, but specifically emphasized the following circumstances; that the criminal offense was committed with a high degree of intent, the accused was a member of the Kosovo Police and that the offense was committed with an official weapon, a circumstance which is assessed as particularly aggravating by the fact that the position of the accused has caused consequences not only to the victim, but also to the trust in security institutions and citizens in general, then the circumstances under which the offense was committed without any motive, the victim was a vulnerable person and did not have the opportunity to defend himself, his behavior after the offense “, attempting to conceal the crime and destroy the evidence, the fact that the victim was young, married and a parent of minor children”, it is said in the notification of the Supreme Court

Therefore, “in the above-mentioned circumstances and in the absence of mitigating circumstances”, the Panel of the Supreme Court has assessed that “it will not be able to justify the imposition of a more lenient sentence than the one imposed by the court of first instance”. / Voice

US Ambassador to Kosovo Philip Kosnett has congratulated Judge Gresa Caka-Nimani on her new position as President of the Constitutional Court.

Kosnetti said the United States remains committed to helping institutions in Kosovo strengthen the rule of law.

“Congratulations to Judge Gresa Caka-Nimani for her new position as President of the Constitutional Court of Kosovo. “The independence of the judiciary is a cornerstone of any strong democracy, and we remain committed to helping Kosovo’s institutions to promote and strengthen the rule of law,” Kosnetti wrote on Twitter.
