In the absence of the prosecutor, the trial of the former police officer accused of shooting his ex-wife is postponed
The absence of prosecutor Javorka Prlinqevi shkak led to the postponement of the retrial session in the case of the accused for attempted aggravated murder, Artim Gashi.
The presiding judge, Judge Naser Foniqi, announced that prosecutor Prlincevic was regularly summoned, but did not appear at Friday’s hearing, reports “Oath of Justice”.
The accused Gashi was not present at the hearing either, for whom Judge Foniqi said that the court did not send an order for conduct.
However, when he contacted the Transport Unit, specifically the official Bujar Zeqiri, the latter informed him that they were able to bring the accused to court within 30 minutes.
However, in the absence of the prosecutor, the judge did not issue a warrant for conduct.
Present in the courtroom were the defense counsel of the accused, lawyer Mentor Neziri, the court translator, Blerta Bekteshi, the father of the injured party BC, as well as the experts of the Institute of Forensic Psychiatry, Dr. Bujar Obërtinca, Dr. Valbona Blakaj-Ramadani and clinical psychology Arife Veseli.
In the absence of legal conditions for holding the hearing, it was postponed to May 11, 2021, at 13:10.
Otherwise, the Basic Court in Prishtina, in September 2018, had sentenced former police officer Artim Gashi to 15 years in prison for the criminal offense of “attempted aggravated murder”.
However, the prosecution remained dissatisfied with the amount of the sentence, which had appealed against this judgment, requesting the latter to impose a higher sentence of imprisonment on the accused.
Regarding this case, the Court of Appeals, on December 17, 2020, annulled the judgment of the Basic Court in Prishtina and returned the case for retrial, suggesting that a super expertise be appointed, where at least one of the experts is a university professor. of the relevant field. According to the Appeal, after receiving the expertise, it is evaluated and decided according to law.
According to the indictment completed on March 23, 2021, Artim Gashi is being accused that on February 4, 2017, around 09:30, in “Xhavit Ahmeti” street, in Prishtina, after a preliminary preparation, he had accompanied the injured party BC from home, who had gone to the faculty exam, stopped him and tried to force him into the car.
However, according to the indictment, after the injured party had refused, in order to deprive her of life, with an official weapon, type “Glock”, he had hit her with a bullet in the head, exactly in the left eye, a blow from which the victim had torn the tissues of his left eye, while the bullet had penetrated the brain, tearing his brain membrane, in which case he had caused serious bodily injuries to the victim, life-threatening with permanent health consequences. It states that the defendant had left the scene.
With this, the prosecution charges the accused Gashi with the criminal offense of “attempted aggravated murder” under Article 173 paragraph 1, points 1.3 and 1.8. regarding Article 28 of the CCRK.
